RE JV Transactions
Joint Venture is a veritable tool for rapid real estate and commercial properties in the world. ‘Informal’ Joint Ventures have been the cause of the development of most of the residential houses in Nigeria, especially the Lagos city area.
Usually, a land owner with a lack of finance and lack of access to finance, wishing to keep his or her property for his upcoming generation, will seek out a “developer” who takes up the cost of development under an agreement.
The “developer”, upon completion of the development, allocates an agreed portion to the land owner and collects rents on the remainder for upward of 30 years or more. At the end of the agreement, the land and property revert to the land owner 100%.
Formal JV involves the land owner who wishes to maximize returns of the value of his or her land. Investors are sought who take up the development, sales, and delivery of buildings to buyers. The profits of the JV are shared among or between the JV partners and the relationship ends.
Alternatively, the units of houses or apartments developed are shared and the parties can do whatever they desire with their share. The management of the property may be an income-generating business for the land owner or the JV partners, based on their agreement.
